MEMORANDUM OPINION AND ORDER

GETTLEMAN, District Judge.

Plaintiff R.R. Donnelley & Sons Company has brought suit against Q. Todd Dick inson, Under Secretary of Commerce for the Intellectual Property and Director of the United States Patent and Trademark Office, pursuant to 28 U.S.C. § 1338(a), to appeal his denial of plaintiffs repeated attempts to have plaintiffs patent reinstated. Both parties have filed motions for summary judgment. For the reasons set forth below, the court grants summary judgment for defendant.
