The plaintiff in error, hereinafter called defendant, was convicted in the superior court of Okmulgee county on a charge of robbery with firearms, and was sentenced to- serve a term of 15 years in the state penitentiary.
The evidence for the state tends to show that at the time charged one H. Lipschnitz was held up and robbed, about 2 or 2:30 a. m., on a highway bridge near Okmulgee. The only person identifying defendant as the person who committed the robbery is Lipschnitz. His testimony is positive.
