The plaintiff in error, hereinafter called defendant, was convicted in district court, Grant county, of robbery with firearms and was sentenced to serve a term of 20 years in the state penitentiary.

On the night of April 13, 1932, the First National Bank of Medford was robbed by two men who entered by breaking windows. The steel safe, four inches in thickness, was burned through by an acetylene torch and more than $4,400 in money taken, in addition to bonds and travelers’ checks.
