THIS CAUSE comes before the Court upon defendants’ motion for summary judgment [DE 25] filed on June 24, 2008 along with their statement of material facts [DE 22]. Plaintiff responded [DE 27] on July 14, 2008. Defendants replied [DE 30] on July 24, 2008 along with their objections to plaintiffs statement of facts [DE 31] and filed their objection to the admissibility of Harvey Gerdy’s declaration [DE 32].
