In this action for breach of contract for failure to pay a commission, the defendant appeals and *502the plaintiff cross appeals from the judgment of the trial court rendered after a jury verdict for the plaintiff.1 The jury returned a verdict for the plaintiff in the amount of $375,000. The trial court denied the defendant’s motion for judgment notwithstanding the verdict but granted the defendant’s motion for a remittitur.
