This action is brought by plaintiffs to recover upon

rescission because of the alleged misrepresentations claimed to have been made by defendant. The action is the result of the purchase by plaintiffs of certain bonds of the Green Star Steamship Corporation from the defendant. The complaint alleges four causes of action in which plaintiff seeks to recover the sum of $66,776.41. This sum represents the purchase price of said bonds. The sufficiency of the complaint has been upheld. (127 Misc. 45; affd., 219 App. Div. 711.) The failure of plaintiffs to restore to the defendant the original bonds…
