Appeal by the defendant, The San Domingo Improvement Company of Hew York, from an order of the Supreme Court, made at the Hew York Special Term and entered in the office of the clerk of the county of Hew York on the 19th day of February, 1909, denying the defendant’s motion to vacate or limit an order for the examination before trial of two persons not parties.

Ingraham, J.:

This was an action to recover for legal services rendered by the plaintiff’s testator to the defendant. The complaint alleges the incorporation of the defendant under the laws of the State of Hew Jersey; that the plaintiff’s' testator was immediately after the organization of the defendant retained as general counsel for the defendant, and that acting in such capacity he performed services for the defendant alleged to be worth the sum of $101,250, of which the defendant lias paid the sum of $3,934.55:.
