The plaintiffs appeal from an order and judgment dismissing the complaint as to the defendant Joseph Mercadante for insufficiency.
In the first cause of action each plaintiff has alleged substantially that it was an insurance company; that its intention and practice was at all times to buy and retain only bonds which were investments, as distinguished from speculations, and which could be safely retained to maturity; that this was at all times known to the defendants; that it purchased bonds in reliance upon ¡representations of the defendants which gave them this character; that after the…
