This is another controversy growing out of the system of reclamation ox desert land in certain public land states provided by the Act of A.ugust 18, 1894, known as the Carey Act (28 Stat. 372, 422), as amended by the Act of June 11, 1896 (29 Stat. 413, 434 [Comp. St. §§ 4685, 4686]). The public lands involved in this case are located in the state of Idaho, and the statutes of that state relating to the appropriation of water for the co-operating scheme in reclaiming the desert lands of the state are found in sections 1613 to 1634 of the Revised Codes of Idaho of 1908…
