This case was initiated by the plaintiff, Joseph C. Segen, M.D., against Buchanan General Hospital, Inc., (“Buchanan General”), Dr. J.N. Patel, M.D., Dr. Dinkar Patel, M.D., Dr. Doric Turjman, M.D., Sue Rife, Joan Jamison, Kenneth Joseph Stephens, Beverly Anderson and Fred Pelle, (collectively “the defendants”). 1 The matter is currently before the court on the defendants’ motions to dismiss the plaintiffs claims pursuant to Rule 12(b)(1) of the Federal Rules of Civil Procedure for lack of subject matter jurisdiction.
