MEMORANDUM OPINION

Plaintiff Kyaw Zaw Nyunt brings this action against defendant Kenneth Y. Tom-linson in his official capacity as Chairman of the Broadcasting Board of Governors (“the Board” or “BBG”) alleging “discrimination based on age, race, national origin, and retaliation,” and seeking review of allegedly “unauthorized agency action.” Compl. at 1.
