Gene Troiano appeals the decision of the Cuyahoga County Court of Common Pleas denying his motion for judgment filed pursuant to R.C. 119.12. The facts giving rise to this appeal are as follows.
By order dated April 3, 1985, the Ohio Real Estate Commission (hereinafter “commission”) denied appellant’s application to sit for the real estate brokers’ examination. On April 16, 1985, the commission received appellant’s notice of appeal to the Cuya-hoga County Court of Common Pleas pursuant to R.C. 4735.19 and R.C. 119.12.
