In April 1937, in the First judicial district court, Douglas County, respondent, as plaintiff, commenced civil action No. 595 against George Miracle. In substance, the complaint in that action alleges:

That on May 21, 1920, and continuously for a long time prior thereto, Katherine Smith Hill, predecessor in interest of plaintiff and of defendant Miracle, was the owner of the NW'^ of the SEi/j, of section 27, township 13 N., range 18 E., Mount Diablo base and meridian, said property being adjacent to the townsite of Lakeside, California, on the shore of Lake…
