Appeal from a judgment of the Superior Court of the city and county of San Francisco, and from an order refusing to vacate the judgment. The facts are stated in the opinion-of the-court.

On the 20th of February, 1866, the plaintiff commenced an action to recover of defendants possession of a lot of land situate in the city and county of San Francisco. The complaint is in the usual form in the action of ejectment, so called, in this state.

To this complaint the defendants, by J. P. Treadwell, as their attorney, filed an answer.

The answer denies each and every allegation of the complaint, and then proceeds for a further and separate answer to aver that J. P. Treadwell at all times in the complaint mentioned and long before was and ever since has been and still is the owner of…
