PLEASANTS, Associate Justice.

Appellee brought this suit to recover of appellant damages for injuries to his person alleged to have been caused by the negligence of appellant. The trial of the cause in. the court below resulted in a verdict and judgment in favor of appellee for the sum of $7000, from which judgment appellant prosecutes this appeal. The petition charges the defendant with negligence in allowing a defective and unsafe car to be placed in the train on which plaintiff was a brakeman, and in failing to notify platdtiff of the condition of said car, and further alleges that the…
