Almand, Justice.

The main and controlling issue of law for review in this case is a consequence of the tragedy of June 3, 1962, when many residents of Georgia, including the Clerk of this court, met their deaths in the crash of an airplane at Orly Field, France, on which- they were ■ passengers. Forrest Cumming and his wife Inez Parker Cumming were among the passengers. No children survived them. Both left wills which were probated.
