Floyd L. Norton, testator, died October 23,1980. He was survived by a widow, ten adult children, and twelve grandchildren. Testator’s *597last will and testament was offered for probate over objections of three of the testator’s sons, J. Richard Norton, Spence C. Norton, and Sidney W. Norton, who were specifically excluded under the will. See Norton v. Ga. R. Bank &c. Co., 248 Ga. 847 (285 SE2d 910) (1982).

The Georgia Railroad Bank & Trust Company, appellee, was named executor and trustee under the will. Appellee filed a complaint in the Superior Court of Jefferson County in September of 1982,…
