This is a petition for instructions by a trustee under the will of Michael Roughan, hereinafter referred to as the testator, who died December 27, 1912. The sixth clause of his will provided: “I give, devise and bequeath to my said brother, James Roughan, the sum of fifteen thousand dollars ($15,000), the same to be held by him in trust as the Robert J. Roughan Trust for the purpose of paying from the income therefrom for the care and support of my brother Robert J.
