Plaintiff PBI Performance Products, Inc. (“PBI”),- a developer of flame and thermal resistant fibers, has sued defendant NorFab Corporation (“NorFab”) for: (1) infringement of its Patent No. 6,624,096 (“the '096 patent”), in violation of 35 U.S.C. § 271, et seq. in Count I; (2) unfair competition and false designation of origin and false and misleading representation in connection with use of a trademark and trade dress under 15 U.S.C. § 1125(a) in Count, II; and (3) trademark and trade dress dilution in violation of 15 U.S.C. § 1125(c) in Count III.
