Defendants in error have by cross-petition in error prayed that this appeal be dismissed, and under the provisions of the governing statute and former decisions of this court, hereinafter cited, it is necessary that the prayer be granted, and the appeal be dismissed.
When the motion for new trial was overruled th'e trial judge granted plaintiffs in error 60 days in which to prepare and serve case-made or transcript.’ After more than half of that time had expired one of the plaintiffs in error instructed the court reporter to prepare a case-made.
