SELBY, Justice.

Appellant Robert C. Coleman executed a waiver of his right to trial by jury. He was tried before the court and found guilty of Murder, Ind.Code § 35-42-1-1 (Supp.1991), and Carrying a Handgun Without a License, a Class D Felony, Ind.Code-§ 35-47-2-1 and 23(c) (1988). The trial court sentenced Coleman to sixty years for Murder and one and one-half years for Carrying a Handgun Without a License, sentences to run concurrently.

This appeal was originally docketed in this Court in 1993. Coleman then sought a remand to the trial court to pursue a petition for post-conviction relief.…
