This is an appeal from a judgment of the circuit court of Schuyler county in favor of the- appellee, the Sanitary District of Chicago, entered upon a verdict of not guilty in this action on the case brought by the appellant, Daniel Shaw, for damages occasioned by the flooding of his lands.

The suit was begun on February 3, 1914, and the amended declaration set forth facts which were held in the case of Jones v. Sanitary District of Chicago, 252 Ill. 591, to constitute temporary damages to the land, and claimed compensation for such damages during the five years prior to the beginning of the…
