On February 9, 1911, Henry Vette, appellee, brought an action on the case in the superior court of Cook county against the Sanitary District of Chicago to recover damages to his farm lands, alleged to have been occasioned by waters from the canal constructed byr the sanitary district. The declaration as originally filed consisted of two counts.
