Marvel, Vice Chancellor:

Plaintiffs, who are allegedly members of Mount Zion Cemetery Association, brought this action for the primary purpose of preventing such defendant from selling a portion of its cemetery property. Mount Zion Cemetery Association is a non-profit corporation incorporated in 1903 for the purpose of maintaining a place of “sepulture or burial of the dead” in Wilmington, its charter providing inter alla that such corporation shall have the power “* * * to purchase, take, own, hold, deal in, * * * or in any manner whatever dispose of real property, wherever situated * * Title…
