— Appeal is taken herein by defendants from a judgment in favor of plaintiff John B. Bertero following a trial without a jury.

Plaintiff’s action is one in equity in which he sought a judgment for declaratory relief with respect to the rights and duties of himself and the defendants to three written contracts.
