This case is before us upon a report by the judge who heard it without a jury in the Superior Court. The plaintiff sues as assignee of S. Shapinsky and Company of Louisville, Kentucky, for damages caused by failure of the defendant to deliver goods of the quality required on a sale by sample alleged to have been made by them to S. Shapinsky and Company through an agent, Simmons.
