This was an action upon a promissory note. There was a verdict against both defendants for $1, and from the judgment rendered thereon against one of them alone, plaintiff prosecutes error.
The first assignment argued is that the verdict is contrary to the evidence. The note in suit represents a portion of the purchase price for a certain meat market, fixtures, outbuildings, corrals, etc., sold by plaintiff to the defendant Rebecca S. Besack.
