C & M Constructora, S.A. (C & M) appeals from the July 13, 2005, amended judgment nunc pro time of the district court in which the district court granted summary judgment in favor of Constructo-ra Andrade Gutierrez, S.A. (CAG) on its claim against American International Insurance Company of Puerto Rico (AIICO); granted summary judgment in favor of AIICO on its third-party claim for indemnification against C & M; and dismissed C & M’s cross-claims against CAG on the basis that the cross-claims were subject to mandatory arbitration.
