MEMORANDUM OPINION

ROYCE C. LAMBERTH, District Judge.

Upon consideration of defendants’ Motion for Summary Judgment on all counts [82], plaintiffs Opposition [90], defendants’ Reply [93], the applicable law and the record herein, for the reasons set forth below, the Motion for Summary Judgment is denied as to Counts V and VI and granted as to Counts I-IV and VII-IX.
