FINDINGS OF FACT AND CONCLUSIONS OF LAW
HAND, Chief Judge.
This cause is before the Court on motions for summary judgment filed, respectively, by the plaintiff, Marine Coatings, Inc. and the defendant, the United States of America. The motions for summary judgment were filed following the remand of this action from the Eleventh Circuit Court of Appeals. The Eleventh Circuit reversed this Court’s dismissal of this action for lack of jurisdiction and remanded the case to have the motion to dismiss treated as a motion for summary judgment.
