The pertinent allegations of the plaintiffs’ complaint are succinctly summarized by Denny, J., in stating the facts in connection with the opinion in the decision on the former appeal. 231 N.C. 386, 57 S.E. 2d 401. There, it appears that the plaintiffs originally set up and declared upon a parol contract by the terms of which they alleged the defendant agreed to lease to them two tobacco sales warehouses in the city of Fayetteville for a term of three years.
