Spain, J.
On June 9, 1995, petitioner was arrested for driving while intoxicated (hereinafter DWI) and arraigned in Town Court of the Town of Jay, Essex County. At the completion of his arraignment, petitioner’s driving privileges were suspended pursuant to the mandatory provisions of Vehicle and Traffic Law § 1193 (2) (e) (7). Thereafter, petitioner was indicted and arraigned in Essex County Court on a five-count indictment which included charges of operating a motor vehicle while having a blood alcohol concentration of .10% or more (see, Vehicle and Traffic Law § 1192…
