Appeal from a judgment of the Supreme Court (Coccoma, J.). entered February 5, 2008 in Delaware County, which dismissed petitioners’ application, in a proceeding pursuant to CPLR article 78, to determine, among other things, that the office of respondent Delaware County District Attorney was not authorized to participate in a hearing conducted pursuant to Vehicle and Traffic Law § 1193 (2) (e) (7).
