On the court’s own motion, it is, Ordered that the decision and order of this court dated December 11,1989, which determined an appeal by the plaintiff from so much of an order of the Supreme Court, Nassau County (Roberto, J.), dated March 25, 1988, as denied its motion for summary judgment, and a cross appeal by the defendants from so much of the same order as denied that branch of their cross motion which was for partial summary judgment dismissing the plaintiff’s second and third causes of action, is recalled and vacated, and the following decision and order is substituted therefor:
