—In an action to recover damages for breach of contract and legal malpractice, the defendant appeals from so much of an order of the Supreme Court, Westchester County (Nicolai, J.), entered November 30, 1993, as (1) granted the branch of the plaintiff’s motion which was to strike the defendant’s affirmative defense of failure to state a cause of action and (2) denied the defendant’s cross application for summary judgment dismissing the complaint.
