In an action to recover damages for fraud and deceit, the defendant appeals from a judgment of the Supreme Court, Westchester County (Jones, J.), in favor of the plaintiff. In a second action to recover damages for breach of contract, the defendant appeals from so much of an order of the same court (Ferraro, J.), as denied that part of his motion which was for summary judgment dismissing the first cause of action and plaintiff cross-appeals from so much of the order as granted that part of the motion which was for summary judgment dismissing the second cause of…
