This case presents a close jurisdictional question involving the potential application of the so-called “unique circumstances” doctrine, a judicially created exception to mandatory filing rules that sometimes justifies our exercise of jurisdiction over untimely appeals. Defendant-appellant Dow Chemical U.S.A. (“Dow”) appeals the district court’s denial of several post-trial motions challenging a final judgment entered in favor of plaintiffs-appellees Mr. and Mrs. Jesse Pinion (“the Pinions”).
