Before the Court is Mosaic Fertilizer, LLC’s motion to dismiss the complaint for failure to state a claim. For the reasons that follow, the motion is GRANTED.
Background
This litigation" arises out of a construction project nonpayment dispute between Mosaic Fertilizer, LLC, as owner, CCC *518Group, Inc., as general contractor, and JP Mack Industries, L.L.C., as subcontractor.
