On the 7th day of December, 1923, J. H. Tackett married Elizabeth Lucas, .and the defendant in error, Rosalie Tackett, was on the 11th day of September, 1924, born as the issue of that marriage. On October 17, 1924, J. H. Tackett sued his then wife for divorce, and while there seems to be some question about the matter of valid decree, it will be assumed for the purpose of this opinion that a valid default decree was granted shortly thereafter.
