This suit was instituted by the appellants against the appellee to recover a three-sevenths interest in a brick storehouse and lot situated in the city of Terrell, Texas. After alleging in the usual form of an action of trespass to try title, that the plaintiffs were, on the 26th day of October, 1905, lawfully seized and possessed of said property, and were on that date wrongfully dispossessed of the same by the defendant, etc., the petition further alleged, in substance, that B.
