MEMORANDUM OPINION AND ORDER

BABCOCK, District Judge.

This is a citizen’s enforcement action under the Resource Conservation and Recovery Act (RCRA). Plaintiff Sierra Club moves for partial summary judgment seeking declarations that certain materials mixed with plutonium, once burned and now stored at the Rocky Flats Plant, are subject to RCRA regulations as hazardous waste within the meaning of Subtitle C of RCRA, 42 U.S.C. §§ 6901-6991i.
