This action was brought on behalf of the United States Environmental Protection Agency (“EPA”) under the Resource Conservation and Recovery Act, as amended (“RCRA”), 42 U.S.C. § 6901 et seq. The United States alleges that T & S violated section 3005 of RCRA by failing to certify its compliance with the financial responsibility requirements of RCRA and by continuing to operate its hazardous waste land disposal facility, without interim status or the required RCRA permit, after the November 8, 1985, statutory deadline.
