MEMORANDUM OPINION
CHASANOW, District Judge.
Presently pending and ready for resolution in this land use case are (1) Defendants’ motion for summary judgment on Plaintiffs’ claims for unconstitutional impairment of the obligation of contract, for a declaratory judgment that a 1989 Development Agreement between the parties is a valid and binding contract, for the court to enjoin Defendants from enforcing the rezoning of a tract of land, and for breach of contract and (2) Plaintiffs’ cross-motion for partial summary judgment on all counts above except breach of contract.
