Currently before the Court, in this civil rights action filed by William' Pflaum (“Plaintiff’) against the Town of Stuyvesant (“Town”) and Valerie Bertram, Town Supervisor (“Bertram”) (collectively, “Defendants”), is Defendants’ motion to dismiss Plaintiffs Complaint for lack of subject matter jurisdiction pursuant to Fed. R.Civ.P. 12(b)(1), lack of personal jurisdiction pursuant to Fed.R.Civ.P. 12(b)(1), and failure to state a claim upon which relief can be granted pursuant .to Fed.R.Civ.P. 12(b)(6). (Dkt. No. 10.)
