Plaintiffs Alan Carey, Stephen Hoffman, and Jack Leib (the “Supervisors”), who filed this action for a declaratory judgment against Employers Mutual Casualty Co. (“Employers Mutual”), appeal the decision of the District Court denying their motion for summary judgment and granting summary judgment in favor of Employers Mutual. Employers Mutual had issued an errors and omissions insurance policy in favor of Berwick Township, Pa. (the “Township”).
