MEMORANDUM AND ORDER

MANNION, United States Magistrate Judge.

Before the court is the plaintiffs’ post trial motion pursuant to the provisions of Federal Rules of Civil Procedure 50 and 59. (Doc. No. 55)

This case arose from a fire that took place at plaintiffs’ Pugh street rental property in Edwardsville, Pennsylvania. At the time of the fire, plaintiffs were insured by Allstate Insurance Co. Allstate declined to pay their claim stating that plaintiff Anthony Valenti had submitted a fraudulent claim in that he had arranged for the arson of the property.
