ORDER
LAWRENCE, Chief Judge.
In this diversity action the plaintiff alleges that the two defendants are respectively citizens of North Carolina and Florida and that “the real property to which the petition for partition relates is situated within the Southern District of Georgia.” The suit is brought by Wyman C. Lowe in three capacities, individually, as Executor of the Will of his brother, Herbert Mell Lowe, and as Temporary Administrator of his deceased father, Roy E.
