OPINION
GILMORE, District Judge.
On July 10, 1975, defendant Turner Construction Company (“Turner”) entered into a contract with the City of Detroit Building Authority (“DBA”) in which defendant Turner agreed to serve as construction manager for the DBA in the construction of the New Detroit General Hospital.
