LETTOW, Judge.

Nez Perce Tribe (“Nez Perce,” the “Tribe,” or “plaintiff’) alleges that the United States (“the government”) has breached its duties as trustee of certain assets of the Tribe, resulting in financial losses. See Nez Perce Tribe v. United States, 83 Fed.Cl. 186, 187 (2008). Almost immediately after commencing this action, the Tribe filed an action in the United States District Court for the District of Columbia (the “district court”), Nez Perce Tribe v.
