OPINION AND ORDER ON DEFENDANT’S RENEWED MOTION TO DISMISS

WHEELER, Judge.

This case again is before the Court on the Government’s renewed motion to dismiss the complaint of Plaintiff, the United Keetoowah Band of Cherokee Indians in Oklahoma (“United Keetoowah” or the “Band”), pursuant to 28 U.S.C. § 1500 (2006).
